Retirement benefits for Teachers: Gratuity awarded to retired professors/teachers of Chhatrapati Shahuji Maharaj University, Kanpur & Veer Bahadur Singh Purvanchal University, Jaunpur, U.P, India

Around 50 Petitioners who were retired teachers of Chhatrapati Shahuji Maharaj University, Kanpur (formerly known as “Kanpur University”) alongwith those who retired from Veer Bahadur Singh Purvanchal University, Jaunpur had filed Writ Petition bearing No. WRIT - A No. - 3526 of 2025 seeking payment of gratuity along with interest at the rate of 6% per annum with effect from the date of retirement/superannuation till the date of actual payment.

After hearing Advocate Shri Apoorva Bhumesh, Counsel for Petitioners, Hon'ble Allahabad High Court Lucknow bench of HMJ  Rajesh Singh Chauhan vide Order dated 03.04.2025 allowed the Writ Petition. The Court reasoned that the matter in issue was squarely covered by the judgment of the Hon'ble Court passed in batch of petitions leading being Writ A No.5724 of 2024 in Re: University College Ret. Teachers Welfare Asso. Lko. and Another Vs. State of U.P. and Others decided on 01.10.2024. Accordingly Petitioners were held entitled to get the benefit of the order of the Hon'ble Court dated 01.10.2024 passed in the case of University College Ret. Teachers Welfare Asso. Lko. (supra).

It is relevant to mention that in the case of University College Ret. Teachers Welfare Asso. Lko. and Another Vs. State of U.P. and Others decided on 01.10.2024 the Allahabad High Court Single Judge HMJ Manish Mathur, in batch of petitions filed by the Associations of Retired teachers of the State, has held that the teachers of State Universities and their affiliate and associate colleges are eligible for payment of gratuity at the time of superannuation. Opposite parties were directed to ensure payment of gratuity to the petitioners-teachers alongwith interest @ 6% per annum with effect from the date of their superannuation till the date of actual payment.
